TERMS OF USE AND PRIVACY POLICY FOR BUSINESS EXCELLENCE WEBSITE

This document (hereinafter "Terms of Use", "Privacy Policy") details the Terms of Use and Privacy Policy for the Business-Excellence website whose address is https://business-excellence.co.il (hereinafter "the website", "website", "website business excellence") belonging to Ze'ev Ronen (hereinafter "website operator", "website owner", "website administrator").

The conditions detailed in this document are valid for all visitors to the website without exception (hereinafter "the visitors", "website visitors", "the surfers", "website surfers", "the users", "website users").

During browsing of the website and use of the different options within it or the undertaking of any action in the website, either independently or automatically through a third-party system (hereinafter "browsing the website", "visiting the website", "use of the website"), you do hereby confirm the contents and validity of this document.

If you do not agree to one or more of the conditions detailed in this document, you are hereby requested not to make any use of the website. It should be stressed that any visitor to the website declares that they are aware of its conditions of use and accepts them in full, and that he/she or anyone on his/her behalf shall not have any claim and/or lawsuit against the website owner and/or anyone on his behalf, aside from claims related to the infringement of the website owner's responsibilities or those of anyone on his behalf according to these conditions of use.

Section 1: Intellectual property

The website and all information contained therein, including website design, code, media files, graphics, film clips, images, texts, files recommended for downloading and any other material displayed in the website are the full ownership of the website owner and constitute exclusive intellectual property of the website owner, and no use may be made of them without the website owner's written consent in advance.

In addition, it is forbidden to distribute, copy, reproduce, post or process code fragments, graphics, film clips, commercial symbols or any media and contents of any kind without written consent in advance.

Section 2: Website contents and copyrights

We strive to provide you with the information displayed in the website without interruption, although there may be technical considerations, third-party or other problems, interference in website availability, and therefore we cannot ensure that the website will be available to you at all times; no financial or other compensations shall be granted for termination/removal of the website.

Section 2.1: Links to external websites

Links to external websites do not constitute a guarantee that these websites are secure, reliable or of high quality, and visiting them is your sole responsibility and are the area of exclusive responsibility of the website user.

Section 2.2: Posting of website contents by users

As a portion of your activities in the website, you may post contents within it, such as comments to articles, guest articles, surveys and responses to surveys, as well as additional contents.

During posting of contents of any kind in the website, you may utilize only contents for which you have the right to utilize by law. Any infringement of copyrights of contents posted in the website by someone other than the website owner, shall be the full responsibility of the individual/group posting the contents, and the contents poster shall bear all responsibilities or repercussions that may stem from infringement of copyrights of the contents posted in the website.

Section 2.3: Request regarding infringement of copyrights

If you encounter an infringement of your copyrights in the website, please contact the website owner at admin@business-excellence.co.il and the contents infringing upon your rights shall be swiftly removed. In your request, please state the full details of the contents that have infringed upon your rights, including URL's of the pages in which the content appears, as well as reference to the content's copyrights.

The contents will be removed from the website within 14 days of receipt of the above-mentioned email request.

Section 3: Security of website and your information

Section 3.1: Maintaining security of website and your information

The privacy and security of visitors to the website are our primary concern, and we will ensure that the website and all the information passing through it shall be secured, through several means:

Browsing of the website and of all information passing through it are secured via security company Comodo's SSL certificate.

In addition to SSL encryption, we use 3 levels of security to ensure that the website is secure and maintains the highest of security standards, including when these standards are updated: a monitoring and security system in the website's storage server, a Firewall system installed in the website, which monitors all traffic, and a CDN (Content Distribution Network), which provides an additional level of security.

The website operator, or anyone on his behalf, shall regularly monitor all data from all systems, and, when necessary, shall take immediate action.

The website owner is obligated to continue to maintain ongoing website security and to update the means of security when necessary, in order to ensure that the data of website visitors is absolutely secure.

We clarify that in light of the dynamics of the technologies utilized in the website, and the possibility of technological faults that are independent of the website operator, the website operator shall not bear any financial responsibility of any kind to surfers, if they should incur financial or other damage as a result of site breaching or other technical faults in website security and/or third-party systems related to it.

Section 3.2: Credit card, password and payment details

Credit card or PayPal account details of website visitors shall never be stored or requested.

During payment to the online website store, the surfer shall be directed to the payment provider's website (eg. PayPal) for action of payment, and credit card details and/or payment provider account details shall not pass through the site or be stored therein.

Your password for website entry is encrypted in our database, and you may change it anytime, via your profile editing page on the site (for this page, click here).

Section 3.3: Sharing of information

We shall never sell or forward your information, or information about you, to any third-party individual or system – for free or for payment – excepting systems we use for website operation or other operations by the website owner.

Your information may be used by third-party systems and/or other individuals in a number of cases:

  1. If you undertake an action in the site using a third-party system requesting your information. For example: When linking to the site via Facebook, with payment to the online store using PayPal, during registration for blog updates via the MailChimp system, and other cases.
    In these cases, your information shall be transferred directly to the relevant system and shall not be stored on the website.
  2. If the website owner uses a third-party system which then makes use of the information in the website.
  3. If the website owner shall be required to share this information by law.

Section 4: Gathering of anonymous information

We gather anonymous information on website visitors for site operation, monitoring of traffic and subsequent improvement in user experience, as well as the need to operate other systems linked to the website and actions of the website owner, including advertising systems.

This information shall never include your identification details, such as name, email address, telephone number, etc.

This information may include details such as the time and day the user visited the site, details on the operation system used by the site visitor, pages they have visited in the website, etc.

Section 5: Gathering of private information

Section 5.1: Gathering of private information by the website

In no stage during your visit to the website do we gather personal information on you that you have not voluntarily chosen to provide us. We only gather the personal information that the visitor has chosen to provide us.

We shall never transfer or sell your personal details to any other party and shall not post them publicly. We may share the information in a secured manner with third-party systems we use to operate the website or any of the website owner's other channels of activity.

We will use the minimum details required for us to operate the website. For example: When registering on the site, we will store the user's name and email address, or other details required to create a user account on the website.

For example: If and when a visitor fills out a form on the website, we will save the details filled in in the form. If the visitor has made a purchase at the online store, we will save the purchase details that do not include credit card data, such as date, sum of purchase, etc.

The information gathered may change according to the activities of that user in the website and/or contents they may wish to see, and may include information not detailed in this document.

We will use the information gathered for operation of the website and provision of the various services offered to users in the site.

We may store the gathered information on third-party systems and make use of it via these systems, eg. system for issuing of invoices for store purchases, system for sending email updates and various marketing and advertising systems.

It should be stressed that at no stage will we store or request your credit card details and/or login passwords for your PayPal or any other accounts.

Section 5.2: Gathering of personal information by third-party system

As a portion of use of the website, the surfer may make use of third-party systems. For example: during registration to the website through a Facebook account, the user will be directed to the Facebook system to complete registration.

These systems may ask you for additional information and store it separately from the information stored in the website.

Section 5.3: Request to delete information and/or account

At any stage, you may request that we delete any information about you stored in the site and/or to delete your account in the website.

This information includes your name and email address, date of registration on the website and date of your last visit, data regarding purchases you have made in the website's online store, other information you have keyed into your personal profile on the website, and any public presence in the website, eg. profile page, questions and/or responses to questions posted, etc.

To request deletion of information and/or your profile, please contact us at admin@business-excellence.co.il and specify in the title of your email "Request to delete information on Business-Excellence website". In the body of the email, please state details identifying your account on the website: email address and username. Please also state the information you wish to have deleted.

Deletion of this information shall take place within 31 days from receipt of the above-mentioned email and if it is sent according to the rules detailed in this section.

Section 6: Sending emails and notifications

As a portion of your activities on the website as a registered user and/or purchaser from the store, you may receive automatic or manual emails sent to you from the website and;/or by the website operator or someone on his behalf for various reasons – usually due to an action you performed on the site, like filling out a form or making a purchase.

For example: After filling out the form on the site, you will be sent a thank you email. After purchasing from the store, you will be sent a confirmation email and/or an email with a tax invoice.

Other systems installed in the site may send you emails for reasons not detailed in this document, and we may add various systems and/or new notifications in future, which will be sent to site visitors for reasons not detailed in this document.

These email notifications may include marketing content promoting profession services of the site operator and/or different options for action and/or purchase in the site.

During surfing of the site and use of the different options, you hereby confirm your acceptance of email notifications related to your activities in the site.

Aside from website operation, the site owner also operates an email mailing list (newsletter list) which surfers may join by choice through the site or another location. It should be clarified that the conditions in this document do not refer to the mailing list and are not valid for it.

Section 7: Use of cookies

To enable an optimal user experience in the site, the site and third-party systems installed in it will make use of cookies to operate the site and for security needs, optimization and marketing.

Cookie files are text files stored in your computer and identifying you to the site or third-party system, in part to enable you to register on a site, to receive support and to make online purchases.

You have the option to cancel the use of cookie files and/or to delete all the cookie files currently in your computer, from the settings of the web browser you are surfing with.

Section 8: Jurisdiction

Any legal dispute related to the website and browsing therein and/or any claim and/or lawsuit initiated by one of the website visitors and/or someone on their behalf, against the website owner and/or anyone on his behalf, shall be discussed in an Israeli court and in accordance with Israeli law.

Section 9: Updates to these conditions

The website owner and/or anyone on his behalf is authorized to action changes under these conditions at their sole discretion and at any time they choose.

A condition update shall become valid from the date of modification of this document and the last modification date for the conditions will appear at the top of this document.

Responsibility for monitoring changes in conditions shall be borne by website visitors, and website visitors and/or anyone on their behalf shall have no claim and/or lawsuit against the website owner and/or anyone on his behalf following changes implemented in these conditions.
